為了執行我們的業務，包括提供服務及/或產品、準備提案、提供報價、處理保險、 管理申訴、管理客戶關係以及進行利益衝突內部查核，您（包括個人客戶及公司客戶） 須提供您、您的代表或您的員工的個人資料（簡稱「個人資料」）予美世（下稱「美 世、我們或我們的」）。此項個人資料受可適用的個資法、隱私法或其他有關法令的 管轄，包括身份文件之影本或其他詳細資料、地址及其他通訊資料的证明、姓名、出 生年月日、國民身分證統一編號、護照號碼、特徵、指紋、婚姻、家庭、教育、職業、 病歷、醫療、基因、性生活、健康檢查、犯罪前科、聯絡方式、財務情況、社會活動、 任何犯罪或被指控犯罪、任何犯罪或被指控犯罪之程序、此等程序之處置或法院於此 等程序中所為之判刑及其他得以直接或間接方式識別該個人之資料。

It is often necessary for our current or prospective individual clients, or, where our clients are corporate or business entities, their individual representatives and employees (collectively referred to as "clients" and otherwise referred to as "client", "you" or "your") to provide to Mercer (hereinafter referred to as "MERCER", "we", "our" or "us") data about yourselves ("Personal Information") in connection with our business process execution, including delivery of services and/or products, preparation of proposals, provision of quotations, arranging insurance cover, managing claims, client relationship management and conducting internal conflicts checks. Such Personal Information may be subject to applicable data protection, privacy and other similar laws and may include copies and other details of identity documents, proof of address and other contact details, information concerning name, date of birth,, identity card number, passport number, characteristics, fingerprints, marital status, family, education, occupation, medical record, medical treatment, genetic information, sexual life, health examination record, criminal record, contact information, financial conditions, social activities, commission or alleged commission of any offence or proceedings for any offence committed or alleged to have been committed, the disposal of such proceedings or the sentence of any court in such proceedings) and other information which may be used to identify a natural person, both directly or indirectly. 

美世得基於下列特定目的，蒐集、利用及處理您所提供之個人資料：

Personal Information you provide will be collected, used and otherwise processed by MERCER for the following purposes:

客戶關係管理程序，包括必要時進行利益衝突可能性之查核；

client relationship management procedures, including any potential conflict checks as may be required;

提供服務或產品給客戶；

the delivery of services or products to the client;

美世提供特定服務或產品所需之特定目的；

those purposes specifically provided for in any particular service or product offered by MERCER;

從事與保險及相關服務與產品有關之行銷及客戶端分析活動（包括為了提高我們的服務水準或基於我們認為會引起客戶興趣之目的，由美世、Marsh & McLennan公司及其他指定第三人所從事之前述活動）；

conducting marketing and client profiling activities in connection with insurance and related services and products (including those provided by MERCER, other members of the Marsh & McLennan Companies Group and selected third parties for the purpose of improving our services to you or that we think may interest the client)

美世認為有必要且適當而對客戶進行信用評估及其他背景之查詢；

credit assessments and other background checks of the client as MERCER may determine to be necessary or appropriate;

美世進行內部記錄保存；

MERCER’s internal record-keeping;

向客戶收取未結清款項；

collection of outstanding payments from clients;

防止犯罪（包括但不限於詐欺、洗錢、賄賂等）；

prevention of crime (including but not limited to fraud, money-laundering, bribery);

為遵循有關美世提供服務及產品之法定或監管要求，以及依據適用於美世或Marsh & McLennan公司之相關法律、法規、指示、法院命令、章程、方針、通告、規則進行資訊揭露；及

meeting any legal or regulatory requirements relating to MERCER's provision of services and products and to make disclosure under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to MERCER or any member of the Marsh & McLennan Companies Group; and

與上述相關之目的（包括但不限於研究、標竿學習及統計分析）。

purposes relating to any of the above (including but not limited to research, benchmarking and statistical analysis).

美世得通過電子郵件、電信（電話或簡訊）方式或社會大眾媒體，將我們認為您會有興趣的，由指定第三人所提供之產品及服務的相關資訊發送給您。但為該前述行為時，我們仍保持對您的個人資料之管控，且未經您事前同意，我們不會將您的個人資料揭露給該指定第三人。

MERCER may send you information by e-mail, telecommunication means (telephone calls or text messages) or social media about products and services offered by selected third parties that we think may interest you but in doing so we maintain control over your Personal Information and we will not disclose your Personal Information to such third parties without your prior consent.

您提供予美世的個人資料將會被保密，但您在此同意並授權美世得為了上述第2項所列之目的，提供或揭露您的個人資料予下列之對象：

Personal Information provided to MERCER will generally be kept confidential but you hereby consent and authorize MERCER to provide or disclose your Personal Information for the purposes stated in paragraph 2 above to:

基於法律規定，或依主管機關之強制要求或指示，而應為揭露之對象；

any person to whom MERCER is compelled or required to do so under law or in response to a competent or government agency;

處理保險或提供申訴服務之相關對象，例如：保險人、經紀人及服務提供者（包括但不限於顧問、市場研究及品質保證公司）；

relevant parties arranging insurance or providing claims services such as insurers, agents and service providers (including but not limited to consultants, market research and quality assurance companies),

Marsh & McLennan集團及其關係企業；

members of the Marsh & McLennan Companies Group and their affiliates;

政府機關及事業監管單位；

government agencies and industry regulators;

美世的稽核人員、會計師、律師，或其他財務或專業顧問；及

MERCER’s auditors, accountants, lawyers or other financial or professional advisers; and

依據第2項及第8項，美世認為必要且適當之分包商，或提供服務或產品之第三人。

such sub-contractors or third party service or product providers as MERCER may determine to be necessary or appropriate, in accordance with paragraph 2 and paragraph 8.

如未提供個人資料予我們，可能導致美世無法提供您所要求之服務及／或產品。

Failure to provide such Personal information may result in MERCER being unable to provide clients with the services and/or products requested.

我們確認已依據相關法律法規採取了適當的行政管理及安全防護措施及程序，以防止您的個人資料遭未經授權或非法之處理，以及避免您的個人資料遭受意外損失、毀壞或損害。

We confirm that we have implemented the appropriate administrative and security safeguards and procedures in accordance with the applicable laws and regulations to prevent the unauthorized or unlawful processing of your Personal Information and the accidental loss or destruction of, or damage to, your Personal Information.

為了資料保存、處理，或為了代表我們提供任何服務或產品給您之目的，在我們認為有必要且適當之情形下，我們得將您的個人資料傳輸給位於台灣以內或以外之Marsh & McLennan 公司，或提供服務或產品之第三人，接受資料方應遵循保密義務並採取相當的安全防護措施。

Where we consider it necessary or appropriate for the purposes of data storage or processing or providing any service or product on our behalf to you, we may transfer your Personal Information to another member of the Marsh & McLennan Companies Group or third party service or product providers within or outside the country in which MERCER is established, under conditions of confidentiality and similar levels of security safeguards.

request that MERCER specify or explain its policies and procedures in relation to data and types of Personal Information handled by MERCER; and

您得反對美世為了行銷目的而利用您的個人資料，美世接到您的反對通知後，將不會為了該目的而利用您的個人資料；及

communicate to MERCER your objection to the use of your Personal Information for marketing purposes whereupon MERCER will not use your Personal Information for these purposes; and
