With President Biden’s election and Democrats in full control of Congress, a massive shift in the direction of benefits and executive compensation policy is underway. Near-term legislative changes in a broad COVID-19 relief package include subsidized COBRA coverage and other employer-focused health and benefit changes, substantial single-employer pension funding relief, sweeping multiemployer pension reforms, and new executive pay and governance initiatives. More action by Congress on these and other benefits issues is on the horizon. The president, meanwhile, is moving swiftly on his agenda to reverse the prior administration’s benefits positions through executive action, and develop new rules and guidance on a broad array of issues, including sweeping healthcare transparency reforms.
