Join Mercer's April 27 Washington Update Briefing on benefits and executive compensation policy.
The divided Congress isn’t likely to produce major changes for benefits or executive pay, but bipartisan policies could be tacked onto larger bills for passage. These include extending telehealth flexibilities, setting new transparency standards for pharmacy benefit managers, lowering healthcare costs, and dealing with unfinished business related to the recently enacted SECURE 2.0 Act — the biggest package of retirement changes enacted in nearly two decades.
Regulatory activity will remain in high gear as implementation of SECURE 2.0 begins and various healthcare transparency requirements — including prescription drug data collection (RxDC) reporting, surprise billing, and the ban on gag clauses — continues. Guidance on numerous other healthcare issues like the coming end of the COVID-19 public health and national emergency periods, mental health parity, and privacy either has been issued or is expected soon. Regulations reversing prior positions on key fiduciary and investment issues for retirement plans are now in place but face ongoing court challenges. In addition, the Securities and Exchange Commission is implementing a host of executive compensation rule changes, including pay versus performance and clawbacks, and the Federal Trade Commission is proposing a ban on noncompetes.
Finally, several cases that may affect health and retirement benefits are winding through the courts.
