This fall in Congress could bring momentous reforms to employee benefit policy as Democrats aim to muscle through reforms to lower drug costs, expand Medicare, keep enhanced Affordable Care Act subsidies and create a government-run paid leave program, among other initiatives. Potential retirement-related measures include an extension of this year’s pension funding relief and “SECURE 2.0” legislation – with a broad array of changes for defined contribution and defined benefit plans. Meanwhile, regulators are racing to issue guidance implementing surprise-billing legislation before its Jan. 1 effective date, offering temporary enforcement relief from some – but not all – healthcare transparency changes, and developing rules implementing President Biden’s COVID-19 Action Plan, which among other things, requires that all employers with 100 or more employees ensure their workforces are vaccinated or tested at least weekly. A slew of new rules could change the retirement landscape, including a reversal of the prior administration’s positions on key fiduciary and investment issues. Congress may pursue new curbs on executive pay as potential revenue offsets, and mandates for more human capital and diversity disclosures top the SEC’s agenda.
